SMS Terms and Conditions

Durfee Law Group (“we,” “our,” or “us”) provides SMS (Short Message Service) and MMS (Multimedia Messaging Service) communications to clients and prospective clients who opt-in to receive text messages. This service includes appointment reminders, updates related to ongoing legal matters, and other relevant client communications. By opting in to receive SMS/MMS messages from us, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.
1. Program Description
By enrolling in our SMS Program, you authorize us to send recurring text messages to the mobile number you provided. These messages may include:
- Account-related notifications (e.g., billing reminders, password resets)
- Transactional alerts (e.g., order confirmations, shipping updates)
- Customer support and service messages
- Legal recommendations, updates and education
2. Consent to Receive Messages
By providing your mobile phone number and opting in, you authorize Durfee Law Group to send SMS and/or MMS messages to the number provided. Consent is not a condition of receiving legal services. You may opt-in via:
- Our website form with an opt-in checkbox
- Texting a keyword to a designated number (if applicable)
- Signing a paper or digital consent form in our office
- Confirming consent verbally or in writing during a consultation
Consent is not a condition of engagement, however, we must be able to communicate with you in order to complete the work you request of us. If you do not consent, other means of communication must be established.
You must be at least 18 years old (or the age of majority in your jurisdiction) and own or have authorized access to the mobile device and number used to enroll in the SMS Program.
3. Message Frequency
We will send messages only when necessary for:
- Appointment confirmations and reminders
- Updates about your legal matter
- Responses to client inquiries
- Limited messages about recommended or optional legal services (if opted in separately)
Message frequency varies based on client activity but will generally not exceed 5 messages per month unless client communication requires more.
4. Message and Data Rates
Message and data rates may apply depending on your wireless provider and plan. Check with your mobile carrier for details.
5. Opt-Out Procedure
You may opt-out at any time by replying:
- STOP to cancel all SMS communications
- HELP to receive contact information and further instructions
After opting out, you may receive a final confirmation message after which you will no longer receive SMS messages from Durfee Law Group unless you opt back in.

6. Data Privacy
We value your privacy. Your mobile number and any personal information shared via SMS will be handled in accordance with our [Privacy Policy], which outlines:
- We do not sell your data
- We only collect the minimum necessary information
- Your information is used solely to communicate with you and manage our legal services
7. Security of Communications
SMS messages are not encrypted. Do not send sensitive personal or legal information via text message. For matters requiring confidentiality, please contact our office directly by phone or secure email.
8. Supported Carriers and Delivery
Message delivery may be affected by your wireless provider. Durfee Law Group is not liable for delayed or undelivered messages due to carrier restrictions or service outages.
9. Compliance with CTIA & Campaign Registry
Durfee Law Group complies with the guidelines established by:
- The CTIA Messaging Principles and Best Practices
- The Campaign Registry (TCR) via Sangoma's UCaaS/SIPStation platforms
All messaging campaigns are registered through the Sangoma TCR Portal at https://smscampaigns.sangoma.com and include:
- Proper opt-in procedures and call-to-action descriptions
- Accurate business identification
- Approved content attributes
- Valid sample messages
Durfee Law Group does not send prohibited content, including SHAFT-C (Sex, Hate, Alcohol, Firearms, Tobacco, Cannabis) content.
10. Changes to Terms
We reserve the right to update these Terms and Conditions at any time. Continued use of our SMS services after changes constitute acceptance of the revised terms.
