Personal Representative
« Back to Glossary Index
The personal Representative is the fiduciary appointed by the Court to administer the Probate Estate of a Decedent. A Personal Representative is typically named in a Last Will and Testament, but may otherwise be appointed based on statutory priority. Personal Representative includes executor, administrator, successor personal representative, special administrator, and persons who perform substantially the same functions under the law governing their status. The term Personal Representative is a gender neutral term that replaced the archaic Executor or Executrix (largely because hardly anyone knows how to conjugate Latin anymore).
